La omisi\u00f3n genera colapso.<\/strong><\/p>\n\n\n\n<p>El sistema ha perdido su \u00faltima excusa.<br>Ya no se trata de ideolog\u00eda, sino de simple l\u00f3gica de supervivencia.<\/p>\n\n\n\n<p>Cada d\u00f3lar invertido en evitar la muerte multiplica la riqueza.<br>Cada vida salvada es un activo que produce bienestar y civilizaci\u00f3n.<\/p>\n\n\n\n<p><strong>Lo contrario \u2014mantener la omisi\u00f3n\u2014 es elegir la ruina colectiva.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Introducci\u00f3n<\/strong><\/h3>\n\n\n\n<p>Hace m\u00e1s de un a\u00f1o, el arquitecto y l\u00edder humanitario <strong>Roberto Guillermo Gomes (EcoBuddha Maitreya)<\/strong> present\u00f3 una <strong>denuncia formal ante la Corte Internacional de Justicia<\/strong> contra casi 200 presidentes y exmandatarios del planeta, acus\u00e1ndolos de <strong>cr\u00edmenes contra la humanidad por omisi\u00f3n<\/strong>. La denuncia sostiene que estos l\u00edderes, con el poder y los recursos para evitar una cat\u00e1strofe humanitaria global, no han actuado con la debida diligencia para detener la <strong>matanza silenciosa<\/strong> causada por el hambre, las enfermedades prevenibles y la degradaci\u00f3n ambiental.<\/p>\n\n\n\n<p>La denuncia fue <strong>enviada tambi\u00e9n a Kumi Naidoo<\/strong>, exdirector de <strong>Greenpeace International<\/strong> y <strong>Amnesty International<\/strong>, <strong>amigo y contacto personal de Roberto Gomes<\/strong>, con el prop\u00f3sito de que ambas organizaciones eleven la causa ante la Corte Internacional de Justicia y exijan una <strong>investigaci\u00f3n oficial sobre el homicidio global por omisi\u00f3n<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Datos Fundamentales<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Muertes por Hambre<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>9 millones de personas mueren cada a\u00f1o por hambre.<\/li>\n\n\n\n<li>En 20 a\u00f1os: <strong>180 millones<\/strong>.<\/li>\n\n\n\n<li>En 40 a\u00f1os: <strong>360 millones<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Muertes por Enfermedades Prevenibles<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>17 millones de muertes anuales por enfermedades evitables como diarrea, malaria, tuberculosis, VIH\/SIDA o neumon\u00eda.<\/li>\n\n\n\n<li>En 20 a\u00f1os: <strong>340 millones<\/strong>.<\/li>\n\n\n\n<li>En 40 a\u00f1os: <strong>680 millones<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Total (Hambre + Enfermedades Prevenibles)<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>En 20 a\u00f1os: <strong>520 millones de muertes.<\/strong><\/li>\n\n\n\n<li>En 40 a\u00f1os: <strong>1.040 millones de v\u00edctimas.<\/strong><\/li>\n<\/ul>\n\n\n\n<p><strong>Comparaci\u00f3n:<\/strong><br>Durante la Segunda Guerra Mundial murieron aproximadamente <strong>60 millones de personas<\/strong>.<br>\u2192 Las muertes por hambre y enfermedades prevenibles son <strong>17 veces mayores<\/strong> en los \u00faltimos 40 a\u00f1os.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Muertes por Contaminaci\u00f3n del Aire<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>7 millones de muertes anuales (OMS).<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Muertes por Calentamiento Global<\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De 150.000 a 300.000 muertes anuales, en aumento exponencial.<\/li>\n<\/ul>\n\n\n\n<p><strong>Estimaci\u00f3n total global de muertes por causas prevenibles (2004\u20132024):<\/strong><br>\u2248 <strong>500 millones de seres humanos<\/strong>.<br>Una tragedia equivalente a <strong>ocho guerras mundiales<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Fundamentos \u00c9ticos y Morales<\/strong><\/h3>\n\n\n\n<p>\u201cCada alma es valiosa, pero la impiedad de destruir la vida por omisi\u00f3n es imperdonable cuando existen recursos, tecnolog\u00eda y abundancia suficiente para salvar a todos.\u201d<\/p>\n\n\n\n<p>La <strong>omisi\u00f3n deliberada de actuar<\/strong> ante un sufrimiento masivo y prevenible constituye, seg\u00fan los principios del Derecho Internacional Humanitario, un <strong>acto criminal por negligencia institucionalizada<\/strong>, equiparable al <strong>homicidio global por omisi\u00f3n<\/strong>.<\/p>\n\n\n\n<p>Con reservas financieras globales superiores a <strong>50 billones de d\u00f3lares<\/strong> y una producci\u00f3n alimentaria capaz de alimentar al doble de la poblaci\u00f3n mundial, la <strong>falta de voluntad pol\u00edtica y \u00e9tica<\/strong> se convierte en el crimen m\u00e1s grave de nuestra era.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Responsabilidad Jur\u00eddica Global<\/strong><\/h3>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\">\n<li><strong>Homicidio por Omisi\u00f3n y Cr\u00edmenes de Inacci\u00f3n<\/strong><br>La responsabilidad de los l\u00edderes pol\u00edticos y econ\u00f3micos deriva de su <strong>poder efectivo de decisi\u00f3n<\/strong>. CALIFICACI\u00d3N JUR\u00cdDICA<\/h2>\n\n\n\n<p>Con base en los principios del <strong>Derecho Internacional Humanitario<\/strong>, la <strong>Convenci\u00f3n para la Prevenci\u00f3n y Sanci\u00f3n del Delito de Genocidio (1948)<\/strong> y el <strong>Estatuto de Roma (1998)<\/strong>, se sostiene que:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Cuando un conjunto de Estados, corporaciones y fondos de inversi\u00f3n posee los medios para prevenir la muerte masiva y no los emplea, incurre en <strong>responsabilidad internacional por omisi\u00f3n<\/strong>.<\/p>\n<\/blockquote>\n\n\n\n<p>Se propone la creaci\u00f3n de una figura jur\u00eddica espec\u00edfica:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Crimen de Homicidio Global por Omisi\u00f3n Estructural (HG-OE)<\/strong><\/h3>\n\n\n\n<p>Definido como:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cToda omisi\u00f3n colectiva, sostenida y consciente por parte de los Estados o entidades con capacidad tecnol\u00f3gica y financiera suficiente, que provoque la muerte masiva de personas por causas prevenibles, configurando una violaci\u00f3n sistem\u00e1tica al derecho a la vida.\u201d<\/p>\n\n\n\n<p>Ya no es una acusaci\u00f3n moral, sino un argumento con base en <strong>derecho internacional humanitario y ambiental<\/strong>, especialmente si se invoca:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>El principio de \u201cdebida diligencia\u201d estatal y corporativa<\/strong>, seg\u00fan el cual los Estados y empresas que <em>tienen medios para evitar la muerte masiva y no los usan<\/em> incurren en negligencia grave.<\/li>\n\n\n\n<li><strong>El \u201cderecho a la vida\u201d (Art. 6 del Pacto Internacional de Derechos Civiles y Pol\u00edticos)<\/strong>, violado por inacci\u00f3n ante causas prevenibles.<\/li>\n\n\n\n<li><strong>Los Principios de R\u00edo de 1992<\/strong> (precauci\u00f3n, \u201cquien contamina paga\u201d, acceso a justicia ambiental).<\/li>\n<\/ul>\n<cite>\u201cCada a\u00f1o, 14 millones de personas mueren por causas que el sistema puede evitar.<br>El crimen no es la naturaleza.<br>El crimen es la indiferencia.\u201d<\/cite><\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">IV.
